En donde las huelgas se prohíben, ¡no hay derecho a huelga!

Con este comunicado queremos solidarizarnos con los huelguistas del sindicato de controladores aéreos (GDF) del aeropuerto de Frankfurt.

La ilegalización de la huelga, dictaminada por el tribunal laboral de Frankfurt tras una demanda interpuesta por Fraport (empresa privada que gestiona el aeropuerto de Frankfurt) y Lufthansa, pone de manifiesto que no existe el derecho a huelga en Alemania. Este supuesto derecho constitucional ha sido violado de forma sistemática por los tribunales
laborales locales en pro de las empresas.

La ilegalización de esta huelga se ha llevado a cabo bajo pretextos meramente formales. Dos detalles de las reivindicaciones en este conflicto laboral no cumplían con la “paz social” recogida en un convenio colectivo anterior en Fraport. Este es el motivo por el que el GDF tuvo que desconvocar la huelga. Ayer el mismo juez prohibió una huelga de solidaridad de los controladores aéreos al considerarla “desproporcionada”.

La OIT insta al gobierno alemán a garantizar los derechos sindicales.

Tras el reclamo de la FAU de Berlín, la OIT, el organismo laboral de la ONU, reafirma los derechos de los sindicatos minoritarios.

En un informe publicado en noviembre de 2011, la Organización Internacional del Trabajo (OIT) exige al gobierno alemán que se garantice el derecho de la Freie Arbeiterinnen und Arbeiter-Union (FAU) a representar los intereses de sus afiliados, tal como lo disponen los Convenios número 87 y 98. El Comité de Libertad Sindical del organismo de la ONU defiende en especial los derechos de la FAU de Berlín a la libertad de expresión, al acceso al lugar de trabajo de sus afiliados y a la participación en comités de empresa [alemanes] siempre que el número de afiliados sea representativo dentro de la compañía.

The ILO Urges the German Government to Guarantee Trade Union Rights

Following complaints of FAU Berlin, the UN workers' organisation, the ILO reinforces the rights of minority unions.

In its report from November 2011, the International Labour Organisation (ILO) demands the German government to ensure that the Freie Arbeiterinnen und Arbeiter-Union (FAU) could represent the interests of their members, in accordance with Conventions 87 and 98. The Committee on Freedom of Organization of this UN organisation in particular defends the right of free speech for FAU Berlin, the right to access premises in any companies they have members in and the right to participate in workers' councils, if the number of members is representative on the company level.

Resolution Concerning the Legal Rights to Rudolf Rocker's Works

Heiner M. Becker, historian and private scholar, living in Nordwalde, has actually initiated a preliminary investigation by the public prosecution against the internet publishing of at least one work of the famous anarchosyndicalist, Rudolf Rocker (1873 – 1958).

Heiner M. Becker has been assistant for several anarchist papers in Great Britain and France, he bought anarchist bequests for the IISG in Amsterdam whereby he became a friend of Fermin Rocker, Rudolf Rocker's son. Before his death in 2004, Fermin Rocker conferred all rights of Rudolf Rocker's works to Heiner M. Becker.

Rudolf Rocker is one of the most famous protagonists of historical anarchosyndicalism. He was secretary of the International Workers Association (IWA) and of the Free Workers Union, Germany (FAUD), in whose historical tradition the FAU sees itself. As an anarchosyndicalist activist, he published many articles, brochures and other texts for this fierce grassroots union movement, including texts such as the ”Principles of Revolutionary Syndicalism“, “Anarchism and Syndicalism“ and “Anarchosyndicalism“.

Resolución sobre los derechos legales de la obra de Rudolf Rocker

El historiador e intelectual Heiner M. Becker de Nordwalde ha interpuesto recientemente una demanda a través de la fiscalía del Estado en contra de la publicación en internet de una obra del famoso anarcosindicalista Rudolf Rocker (1873-1958).

Heiner M. Becker fue colaborador de varias publicaciones anarquistas en Gran Bretaña y Francia, y aportaba material anarquista al IISG de Amsterdam. De esta manera, se hizo amigo de Fermin Rocker, hijo de Rudolf. Antes de su muerte en 2004, Fermin cedió a Heiner todos los derechos de la obra de su padre.

Rudolf Rocker es uno de los protagonistas más famosos de la historia del anarcosindicalismo. Fue secretario de la Asociación Internacional de los Trabajadores (AIT) y de la Unión de Trabajadores Libres de Alemania (FAUD), en cuya tradición histórica se encuadra la FAU. Como militante anarcosindicalista publicó numerosos artículos, folletos y otros textos para este potente movimiento sindical de base, entre los que se incluyen textos como “Principios del Sindicalismo Revolucionario”, “Anarquismo y Sindicalismo” y “Anarcosindicalismo”.

FAU-IWA Supports Polish Workers Against Wage Theft!

Along the Low Rhine river, in Germany's outer West and adjacent to the Netherlands, thousands of workers from Poland work under precarious conditions in agriculture and gardening. They get cheated out of their wages very often, but occasionally they fight back. The Free Worker's Union (Ger.: Freie Arbeiterinnen- und Arbeiter Union, FAU) practises anarchosyndicalist solidarity with them and thereby demonstrates that borders play no role at all. FAU is the German section of the International Workers Association (IWA).

A lo largo del Bajo Rhin, en el extremo occidental de Alemania y adyacente a Holanda, miles de trabajadores de Polonia trabajan bajo condiciones precarias en agricultura y jardinería. Son engañados en el salario muy a menudo, pero a veces luchan. El Sindicato de Trabajadores Libres (Freie Arbeiterinnen- und Arbeiter Union, FAU) realmente practica la solidaridad anarcosindicalista con ellos y, a través de esto, demuestra que las fronteras no juegan ningún papel en absoluto. FAU Berlin Can Call Itself a Union

About 50 people gathered in the biggest hall of Berlin's Higher Court on the morning of June 10th. They were waiting for the decision on the FAU Berlin's appeal on whether they could call themselves a union. Only 15 minutes into the trial, the judge delivered the verdict. The injunction is overturned; the ban is repealed; the crowd goes wild.

The court emphasized how weak the plaintiff's arguments were. The Babylon Mitte cinema management, where the employees and the FAU have been waging an effective labor struggle since last year, insisted on their point of view: The FAU Berlin is only aloud to call itself a union, if it has proven it has the capacity to conclude collective agreements. This refers to Berlin's Labor Court decision to grant an injunction to Babylon's management banning a boycott call made by the FAU Berlin. That judge justified his decision by saying the FAU Berlin isn't what case law traditionally considers a union with the capacity to conclude collective agreements. Only such union are legally allowed to take job action, i.e. call for boycotts.

La FAU de Berlín puede volver a llamarse sindicato

La sala mayor del Tribunal de Apelaciones de Berlín da cabida en la mañana del día 10 de junio a cerca de 50 espectadores, venidos para escuchar la sentencia sobre el recurso planteado por la FAU de Berlín contra la orden cautelar que le prohibe denominarse a sí misma sindicato. Transcurridos tan sólo 15 minutos queda pronunciada la sentencia, y cerrado el caso: la orden cautelar se declara suspendida, la prohibición de facto está anulada. Los asistentes irrumpen en aplausos.

El tribunal fundamenta su sentencia contrariando explícitamente la argumentación de la parte contraria. La gerencia del cine berlinés Babylon Mitte, cuya plantilla, respaldada por la FAU de Berlín, se le enfrenta desde hace un año en un activo conflicto laboral, sostenía que la FAU berlinesa no puede denominarse sindicato, al no tener la representatividad suficiente para firmar convenios colectivos. Se apoyaban para ello en una sentencia reciente del Tribunal Laboral de Berlín, que prohibía a la FAU -también por orden cautelar- convocar a un boicot del cine, considerando que el sindicato no tenía derecho a firmar convenios según la legislación vigente.

In April, the FAU Berlin was charged 200 Euros for referring to itself as a union in its statutes. In December 2009, an injunction had been issued forcing them to remove the word union from all their publications. However the banned word remained in the statutes until mid-March as a change there would have taken several months. The management of the Babylon Mitte Cinema filed for the charges in February 2010. The injunction was also filed for by the same cinema's management during a labor dispute with its employees, which the FAU Berlin was supporting. This is the first time that a workers' association has been banned from calling itself a union in Germany. Lars Röhm has been the secretary of the FAU Berlin since 2009.
