CNT-AIT Albacete - Labour conflict due to wrongful dismissal and claim of unpaid wages against Asishogar.
In June 2020, the CNT-AIT Albacete union began to take action against the company Asishogar, which manages home-care workers. A comrade of the union was working from July 2019 to January 2020, with a category of Home Help Assistant. On 27 December 2019, she fell ill and was fired at the end of January through a contract termination.
The company is required to:
1) Recognition of the termination of the employment relationship as an unfair dismissal, and not as end of the contract.
2) Payment of compensation for unfair dismissal for the months worked on the basis that the contract is in breach of law and, at least, a compensation of 33 days per year worked would be applied.
3) Claim of unpaid wages based on: not taken holidays (15 days), not taken rest days, night shift differential, wage differences due to the application of 2018 Wage Tables for work carried out in 2019, time spent going from one service to another, Social Security contribution for the week the worker was working without being registered.
4) Resolution and regularisation of the working conditions which have been systematically violated by the company.
The conflict is not yet resolved and the actions continue.
A week of action against unpaid wages will be held from October 12-18. 2020. The actions, which are organized by the International Workers' Association, will focus attention on this problem that workers around the globe face all too often.
The unions of the IWA have often been able to take successful action against various forms of wage theft. One of them is the ZSP. Hundreds of workers have been able to recover wages and other money they were entitled to through action with this union. On the occasion of the International Week of Action, we present the history of a few such cases which show different types of theft such as unpaid wages, underpaid wages, lack of overtime payments, lack of sick pay, vacation time or social security payments (to name the most common).
We live in a society where we have to work for money to survive. We need money for food, housing, education, healthcare but also for culture, recreation, leisure activities etc. Often, we struggle to cover all our costs, so when we aren’t paid for our work at all, the consequences are drastic for us and the people who rely on us. In response to this widespread phenomenon the International Workers’ Association (IWA) decided to set the third week of October as the International Week Against Unpaid Wages.
El pasado jueves 12 de diciembre las empresas Banco Santander, Isban y Panel Sistemas temblaron ante la impresionante movilización de las trabajadoras unidas entre iguales. Las secciones de la Asociación Internacional de los Trabajadores, la Internacional anarcosindicalista AIT-IWA, apoyaron con sus acciones la petición de solidaridad de las trabajadoras en conflicto.
Decenas de acciones se desarrollaron ante la estupefacta mirada de las directivas de las empresas cómplices en el tráfico de mano de obra.
Isban-Banco Santander sigue sin dar muestras de querer terminar con el conflicto, pese al enorme daño que está suponiendo para su ya de por sí ensuciada imagen. La acción directa y las concentraciones a las puertas de las sucursales del banco están dando a conocer a la gente cuál es la verdadera cara de esta aberración capitalista que se lucra con la miseria y destrucción de la clase trabajadora.
El 11-14 de septiembre varias acciones de solidaridad con los trabajadores polacos tuvieron lugar en diferentes países. Hubo acciones en las embajadas y consulados de Polonia en España, Holanda, Eslovaquia y dos ciudades en Australia. Otras acciones también tuvieron lugar en España, donde se colgaron pancartas, en Francia, donde los compañeros repartieron folletos sobre la situación en Polonia durante una huelga y hubo una acción en un lugar donde trabajan polacos y repartieron folletos en Noruega. Las acciones fueron organizadas por Priama Akcia en Eslovaquia, CNT-AIT en España y Francia, ASF de Australia, NSF de Noruega y ASB de Holanda. ¡Gracias a todos por las muestras de apoyo desde el extranjero!
La Asociación Internacional de los Trabajadores (AIT), por medio de su Secretariado condena rotundamente el despido, por parte de la empresa GFK, de la trabajadora Eva López.
Los trabajadores intentaron organizarse para conseguir mejoras en sus condiciones de trabajo, pero el resultado fue la persecución, el acoso, la estigmatización y finalmente el despido de Eva. Este despido ha de ser contemplado claramente como una represalia.
La AIT difundirá la información sobre este injusto despido a nivel mundial y no cejaremos en nuestra solidaridad hasta que a Eva López le sea devuelto su empleo.
